Introduction & Acceptance

Welcome to Aura. These Terms of Service ("Terms") govern your access to and use of the Aura virtual try-on application and related services ("Service"). Aura is an AI-powered virtual try-on solution for Shopify merchants that enables customers to visualize how clothing items look on them before making a purchase.

By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service. These Terms apply to both Shopify merchants who install our app and their customers who use the virtual try-on feature.

AI Technology Limitations

Aura utilizes advanced artificial intelligence technology, which has inherent limitations that users should be aware of. By using our Service, you acknowledge and accept the following:

Content Moderation & Processing Refusals

Our AI incorporates automated content safety and moderation systems that may occasionally flag and decline to process legitimate fashion items. This may affect products including, but not limited to:

• Swimwear, bikinis, and beachwear
• Lingerie and intimate apparel
• Athletic wear and form-fitting garments
• Clothing with certain graphics, text, logos, or designs
• Items with patterns that may trigger content filters

Such refusals are automated responses inherent to the AI technology and do not constitute any judgment on the appropriateness of your products or images. We have no direct control over these content moderation decisions as they are made by the underlying AI systems.

Output Variability & Potential Errors

AI-generated results are probabilistic in nature and may exhibit variability. Users should be aware that the AI may occasionally:

• Return images that appear unchanged, minimally altered, or identical to the input
• Render colors, patterns, textures, or fabric details inaccurately
• Produce visual artifacts, distortions, or inconsistencies
• Generate different results from identical inputs across multiple attempts
• Misrepresent garment fit, drape, or proportions
• Fail to accurately process certain body types, poses, or image qualities

These variations and potential errors are inherent characteristics of AI technology and are not defects in the Service. Results should be considered approximations only.

Credits & Failed Generations

Failed or refused generations do not consume credits. Credits are only deducted when the AI successfully processes and returns a virtual try-on result. If the AI declines to process an image or encounters an error that prevents generation, your credit balance will not be affected.

Third-Party AI Systems

Aura utilizes third-party AI providers to power our virtual try-on technology. These providers may update, modify, or change their AI systems and content policies at any time without notice. We do not have direct control over the underlying AI behavior, content moderation decisions, or processing outcomes. Changes to third-party AI systems may affect the quality, consistency, or availability of our Service.

No Guarantee of Results

Due to the nature of AI technology, we cannot guarantee that:

• All products or images will be successfully processed
• Results will be consistent across multiple attempts
• The Service will work with all types of garments or user photos
• Results will accurately represent how products will look in real life

The Service is provided on a "best effort" basis, and users accept these inherent limitations when using Aura.

Service Description

Aura provides the following services:

• Virtual Try-On Technology: AI-powered visualization that shows how clothing items may look when worn
• Shopify Integration: Seamless integration with Shopify stores for merchants
• Customer Experience: Easy-to-use interface for shoppers to try on products virtually
• Privacy-First Processing: Real-time image processing with no storage of user photos

Account & Access

For Merchants

To use Aura, you must have a valid Shopify store and account. By installing our app, you authorize us to access necessary store data to provide our services, including product information and images. You are responsible for maintaining the security of your Shopify account.

For Customers

Customers access Aura through participating merchant stores. No separate account is required. By using the virtual try-on feature, customers agree to these Terms.

Age Requirement

You must be at least 13 years old to use our Service. By using Aura, you represent that you meet this age requirement.

Billing & Subscriptions

Aura offers various subscription plans for merchants. All billing is handled securely through Shopify's billing system.

• Subscription Plans: We offer different tiers with varying credit allowances and features
• Credit System: Virtual try-ons consume credits based on your plan
• Billing Cycle: Charges are processed through your Shopify account on a recurring basis
• Refunds: Refund requests are subject to Shopify's billing policies

You may cancel your subscription at any time through the Shopify admin. Cancellation will take effect at the end of your current billing period.

Acceptable Use Policy

You agree to use Aura only for lawful purposes and in accordance with these Terms. You agree NOT to:

• Upload inappropriate, offensive, or illegal content
• Attempt to reverse engineer, decompile, or extract source code from our Service
• Use automated systems or bots to access the Service excessively
• Interfere with or disrupt the Service or servers
• Violate any applicable laws or regulations
• Infringe upon the intellectual property rights of others
• Use the Service for any purpose other than its intended virtual try-on functionality

We reserve the right to terminate or suspend access to our Service for any user who violates these terms.

Intellectual Property

Our Rights: The Aura Service, including its original content, features, functionality, and AI technology, is owned by Aura and is protected by international copyright, trademark, and other intellectual property laws.

Merchant Content: Merchants retain all rights to their product images and descriptions. By using our Service, merchants grant us a limited license to process and display their product images for the purpose of providing the virtual try-on feature.

Customer Content: Photos uploaded by customers for virtual try-on are processed in real-time and are not stored. Customers retain all rights to their photos.

Privacy

Your privacy is important to us. Please review our Privacy Policy, which explains how we collect, use, and protect your information.

Key Privacy Commitment: Aura does not store, save, or retain any user-uploaded images. All photos are processed in real-time and immediately discarded after generating try-on results.

Limitation of Liability

To the maximum extent permitted by applicable law, Aura shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, revenue, or business opportunities
• Inaccurate virtual try-on results or visualizations
• Purchase decisions made based on try-on results
• Service interruptions or downtime
• Data loss or security breaches beyond our control

Our total liability for any claims arising from your use of the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied, including but not limited to:

• Implied warranties of merchantability or fitness for a particular purpose
• Accuracy or reliability of virtual try-on results
• Uninterrupted, secure, or error-free operation
• Compatibility with all devices or browsers

We do not warrant that the virtual try-on results will accurately represent how products will look or fit in real life.

Termination

By Us: We may terminate or suspend your access to the Service immediately, without prior notice, for any reason, including breach of these Terms.

By Merchants: Merchants may uninstall Aura from their Shopify store at any time. This will terminate access to the Service.

Effect of Termination: Upon termination, your right to use the Service will cease immediately. Any data associated with your account may be deleted. Provisions of these Terms that by their nature should survive termination shall survive.

Changes to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. If we make material changes, we will provide notice through the Service or by other means. Your continued use of the Service after any changes constitutes acceptance of the new Terms.

We encourage you to review these Terms periodically to stay informed of any updates.

Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Service shall be resolved through good faith negotiations or, if necessary, binding arbitration.
